Terms of service – Eazign for WooCommerce
1. Provider and scope
The provider is Metacom Solutions, owner Gerald Kapp, Fasangasse 28/2, 8075 Hart bei Graz, Austria, info@eazign.at ("Eazign", "we").
These terms apply to the online service Eazign for WooCommerce (the "service", at woo.eazign.at), to which the free WordPress plugin "Eazign" connects. The plugin itself is licensed under the GNU General Public License v2 or later; these terms govern the service.
The customer's own terms do not apply, even if we do not object to them.
2. Businesses only
The service is offered exclusively to businesses that use it for their online store. By connecting the plugin or buying a plan, the customer confirms that they act as a business. Consumers may not use the service.
3. Purchase through Paddle
Our order process is conducted by our online reseller Paddle.com (Paddle.com Market Limited, Judd House, 18–29 Mora Street, London EC1V 8BT, United Kingdom). Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries about payment and handles returns.
Paddle's buyer terms (paddle.com/legal/checkout-buyer-terms) also apply to the purchase. Invoices are issued by Paddle.
4. Trial
After the first connection, every store can use the service free of charge for 14 days, without payment details, with the features of the Pro plan. The trial ends automatically and costs nothing.
Without a plan, the designer in the store and the creation of new products are then disabled. Print files for orders that are already paid are still created.
5. Plans, prices and term
The plans, limits and prices shown on eazign.at/en/wordpress/ and in the plugin at the time of purchase apply. All prices exclude taxes, which Paddle adds depending on the customer's country.
Plans run monthly or yearly and renew automatically for the same period unless cancelled before it ends. The customer can cancel at any time in the customer portal (plugin: Plan & billing → Manage subscription), effective at the end of the paid period.
Plan changes take effect immediately; Paddle charges or credits the difference pro rata.
We announce price changes by email at least 30 days in advance; they apply from the next renewal. The customer may cancel before then.
6. Services and availability
The service provides the designer for the product page, creates product images and products in the customer's store and creates print files for paid orders. The exact scope follows from the product description and the chosen plan.
We aim for high availability but do not guarantee a specific availability. Where possible, maintenance takes place outside usual business hours.
We develop the service continuously and may change features as long as the essential scope is kept.
The customer checks print files before production. We are not liable for misprints from unchecked files.
7. Customer obligations
The customer ensures that they and their end customers hold the rights to uploaded content (motifs, images, texts, trademarks) and that it infringes no third-party rights or laws. The customer indemnifies us against third-party claims based on such content.
The customer informs their end customers about the use of Eazign in the store's privacy policy. The data processing agreement (eazign.at/en/wordpress/dpa/), agreed together with these terms, applies to their end customers' data.
The customer keeps WordPress, WooCommerce and the plugin up to date and protects their access.
8. Data and end of contract
48 hours after the plugin is disconnected or deleted, we delete all of the store's data at the service. The customer should save print files beforehand.
We may suspend access in case of serious breaches of these terms or non-payment.
9. Liability
We are liable only for intent and gross negligence; liability for slight negligence is excluded, except for personal injury.
To the extent permitted by law, liability for lost profit, consequential damage, loss of data and damage from misprints is excluded. Liability is limited to the fees the customer paid in the twelve months before the event causing the damage.
10. Changes to these terms
We announce changes by email to the stored address at least 30 days before they take effect. If the customer does not object and continues to use the service, they are deemed accepted; the notice points out this consequence. If the customer objects, either party may terminate as of the effective date.
11. Law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. Place of jurisdiction is the competent court in Graz, Austria.
If a provision is invalid, the others remain valid.
